In a surprising turn of events outlined in Portugal's 2024 Government Budget, the Non-Habitual Resident regime (NHR) was terminated as of 1 January 2024. However, almost simultaneously, a new regime was introduced by the government, offering tax holidays and exemptions to individuals, employees, and self-employed individuals who relocate their tax residency to Portugal and fulfil specific criteria related to their professional activities.
This new regime, known as NHR 2.0, marks a significant departure from its predecessor, NHR 1.0, which catered to passive income earners. NHR 2.0 now aims to provide relief to active income earners, whether employed or self-employed, who are engaged in technical, scientific, or academic roles within R&D projects for production and development, academia, and start-up ventures.
Access to the benefits of NHR 2.0 may be more restricted, as participation in the program will necessitate involvement in local enterprises with a focus on R&D and innovation. Nevertheless, for those individuals who meet the eligibility criteria, the new regime may offer greater tax efficiency, with the exception of certain pension tax relief provisions.
